Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Workmatix platform and services. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing or using Workmatix services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our services. If you are using Workmatix on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Services

Workmatix provides AI-powered business communication and scheduling tools for small and medium-sized businesses, including:

  • AI voice reception — automated phone answering, call qualification, and callback capture
  • Smart scheduling — availability management, booking holds, and confirmation workflows
  • SMS messaging — transactional text messaging (TCPA-compliant, 10DLC registered)
  • Business analytics — usage tracking, cost controls, and operational alerts

Services are provided on a subscription basis. Feature availability depends on your subscription tier as described on our Pricing page.

3. Accounts & Registration

To use Workmatix, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us promptly of any unauthorized use of your account
  • Keeping your account information up to date

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for an extended period.

4. Billing & Payment

Subscription fees are billed monthly in advance via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in US dollars.

  • Trial period: New accounts receive a 7-day free trial. A valid credit card is required to start the trial.
  • Overages: Voice minutes exceeding your plan allocation are billed at $0.20 per minute. Overages are off by default and must be explicitly enabled by the account owner. Per-tier overage caps apply.
  • SMS activation: A one-time $49 SMS Messaging Activation Fee applies to enable SMS capabilities.
  • Refunds: Subscription fees are non-refundable except as required by law. Pro-rata credits are not issued for mid-cycle cancellations.

5. Acceptable Use

You agree not to use Workmatix services to:

  • Violate any applicable law or regulation
  • Send spam, unsolicited messages, or bulk communications without proper consent
  • Transmit harmful, fraudulent, or deceptive content
  • Interfere with or disrupt the integrity or performance of our services
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the service for any purpose that violates TCPA, CAN-SPAM, or other communication regulations
  • Resell, sublicense, or redistribute access to the platform without written consent

We reserve the right to suspend or terminate accounts that engage in prohibited activities.

6. Intellectual Property

All content, features, and functionality of the Workmatix platform — including software, text, graphics, logos, and trademarks — are owned by or licensed to Workmatix and are protected by intellectual property laws.

You retain ownership of any data you upload or input into the platform. By using our services, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and improving our services.

7. AI Services Disclosure

Workmatix uses artificial intelligence to provide voice reception, scheduling, and messaging services. By using our platform:

  • You acknowledge that callers to your business will interact with an AI receptionist
  • AI disclosure is provided to callers at the start of each call
  • AI-generated responses are designed to be helpful and accurate but may occasionally produce errors
  • You are responsible for reviewing AI-generated bookings, callbacks, and messages for accuracy

Workmatix is not a substitute for professional legal, medical, or emergency services. Do not rely on AI responses for critical decisions.

8. Data Handling & Privacy

Your use of Workmatix is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using our services, you consent to data practices described in the Privacy Policy. For SMS-specific data handling, see our SMS Terms & Conditions.

9. Service Availability & Modifications

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with reasonable advance notice
  • Modify, update, or discontinue features with 30 days notice
  • Experience temporary outages due to factors beyond our control

We will make reasonable efforts to notify you of material changes to the service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKMATIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to Workmatix in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Workmatix, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the services, your violation of these terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing settings in your dashboard or by contacting support.

We may terminate or suspend your account immediately for:

  • Violation of these Terms of Service
  • Non-payment of subscription fees
  • Fraudulent or abusive activity
  • Legal or regulatory requirements

Upon termination, your right to use the services ceases immediately. Your data will be retained for 30 days to allow for export, after which it will be deleted in accordance with our Privacy Policy.

13. Governing Law & Disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), unless you opt out within 30 days of creating your account by emailing legal@workmatix.ai.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Continued use of the services after changes constitutes acceptance of the updated terms. If you do not agree with the changes, you must discontinue use of the services.
